Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services. In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.

Any use of Cookies — or of other tracking tools — by this Application or by the owners of third-party services used by this Application serves the purpose of providing the Service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy, if available.

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.
Legal basis of processing
The Owner may process Personal Data relating to Users if one of the following applies:
- Users have given their consent for one or more specific purposes.
- Provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof.
- Processing is necessary for compliance with a legal obligation to which the Owner is subject.
- Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner.
- Processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.
In any case, the Owner will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.
Place
The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located.
Depending on the User's location, data transfers may involve transferring the User's Data to a country other than their own. To find out more about the place of processing of such transferred Data, Users can check the section containing details about the processing of Personal Data. Users are also entitled to learn about the legal basis of Data transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.
If any such transfer takes place, Users can find out more by checking the relevant sections of this document or inquire with the Owner using the information provided in the contact section.
Retention time
Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Therefore:
- Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
- Personal Data collected for the purposes of the Owner's legitimate interests shall be retained as long as needed to fulfil such purposes.
The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.
Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.
The rights of Users
Users may exercise certain rights regarding their Data processed by the Owner. In particular, Users have the right to do the following:
- Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.
- Object to processing of their Data. Users have the right to object to the processing of their Data if the processing is carried out on a legal basis other than consent.
- Access their Data. Users have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing.
- Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected.
- Restrict the processing of their Data. Users have the right, under certain circumstances, to restrict the processing of their Data. In this case, the Owner will not process their Data for any purpose other than storing it.
- Have their Personal Data deleted or otherwise removed. Users have the right, under certain circumstances, to obtain the erasure of their Data from the Owner.
- Receive their Data and have it transferred to another controller. Users have the right to receive their Data in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance.
- Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Owner or for the purposes of the legitimate interests pursued by the Owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection.
Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time without providing any justification.
How to exercise these rights
Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible and always within one month.

The User's Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to possible legal action arising from improper use of this Application or the related Services. Where we deliver
We deliver anywhere in South Africa, to street addresses (home or work). We don’t deliver to PO boxes or outside South Africa.
Delivery costs
- Free delivery on orders of R500 or more.
- For smaller orders, the delivery fee is calculated at checkout from your address and shown to you before you pay.
How long it takes
- Dispatch: we pack and hand your order to the courier within 1–2 working days of your payment being confirmed. Orders placed after 12:00 on a Friday, or on a weekend or public holiday, are dispatched on the next working day.
- Delivery: after dispatch, The Courier Guy usually delivers within 2–4 working days to main centres and 3–7 working days to regional and outlying areas.
These are estimates. Occasionally, deliveries take longer, for example over public holidays or in bad weather.
Tracking your parcel
When your order is dispatched, we email you a tracking number and a link so you can follow your parcel on The Courier Guy’s website.
Receiving your order
- Please make sure your address and cellphone number are correct at checkout. The courier may call or SMS you to arrange delivery.
- If nobody is available, the courier will try to contact you to rearrange. If a parcel is returned to us because of an incorrect address or repeated failed deliveries, we may need to charge the cost of re-sending it.
- Please check your parcel when it arrives. If it is damaged, or anything is missing or wrong, email info@saya.africa within 48 hours with photos, and we will sort it out (see our Returns & Refunds policy).
Collecting from our office
You’re welcome to collect your order from our office at 213 Northway, Durban North, during office hours (Monday to Friday 9am to 5pm, Saturday 9am to 1pm). Please wait for our email saying your order is ready before you come in.

Returns and Refunds

We want you to be happy with every Saya Africa product. If something isn’t right, here’s how we’ll put it right.
Changed your mind? You have 7 days
You may cancel your online order and return the products within 7 days of receiving them, without giving a reason. This is your cooling-off right under section 44 of the Electronic Communications and Transactions Act.
- For health and hygiene reasons, products must be returned unopened, unused and with their seals intact. Once a seal has been broken, we can’t accept the product back unless it is defective or not what you ordered.
- You pay the cost of sending the products back to us. We pay everything else.
- We refund the full price you paid for the products within 30 days of receiving your cancellation. We aim to do it within 10 working days of receiving the returned products.
Damaged, faulty or wrong items
If your order arrives damaged, if a product is defective or not as described, or if we sent the wrong item:
- Please email us within 48 hours of delivery with your order number and photos of the problem. This helps us claim from the courier, but it doesn’t take away your rights if you notice a fault later.
- Products have a 6-month warranty against defects under section 56 of the Consumer Protection Act. Within that time you may choose a replacement or a full refund.
- We cover the full cost of returning faulty or incorrect items, and we arrange the collection with our courier.
What we can’t accept back
- Products that have been opened or used, unless they are defective or not what you ordered.
- Products returned more than 7 days after delivery for a change of mind.
- Damage caused by misuse, or by not following the directions on the label.
How to return something
- Email info@saya.africa with your order number, the product(s) you are returning, the reason, and photos if the item is damaged or faulty.
- We reply within 2 working days with the return address and instructions (or book a courier collection for faulty or incorrect items).
- Pack the products securely. We recommend a trackable courier, because we can’t refund parcels that don’t reach us.
- Once we have received and checked the return, we email you to confirm your refund or replacement.
How refunds are paid
Refunds go back to the card you paid with, through Yoco. Once we have processed a refund, it can take 5–10 working days to appear on your statement, depending on your bank.
Bought from a Saya consultant?
This policy covers orders placed on saya.africa. If you bought from a Saya consultant or at a home demonstration, please contact your consultant or email info@saya.africa. For purchases resulting from direct marketing, the Consumer Protection Act gives you the right to cancel in writing within 5 business days.

These terms apply to every purchase made on saya.africa (the “website”). By placing an order you agree to them, so please read them carefully. If anything is unclear, contact us before you buy.

2. Our products
We sell Ayurvedic wellness and personal-care products, including Sayadex and Saya’s Hair Care. We describe and photograph our products as accurately as we can, but colours and packaging may differ slightly from what you see on screen.
Health notice: our products have not been evaluated by the South African Health Products Regulatory Authority (SAHPRA) for their quality, safety or intended use. They are not intended to diagnose, treat, cure or prevent any disease, and nothing on this website is medical advice. Individual results may vary. Read the label before use, do a small patch test on your skin first, and speak to a doctor or pharmacist before use if you are pregnant, breastfeeding, taking medication or have a medical condition. Keep out of reach of children. Stop using a product and seek medical advice if you experience any adverse reaction.
3. Prices and payment
- All prices are in South African Rand (ZAR) and include VAT at 15%.
- Delivery costs are shown at checkout before you pay. Orders of R500 or more qualify for free delivery within South Africa.
- Payments are processed securely by Yoco. We accept Visa, Mastercard and American Express credit and debit cards. Your card details are entered on Yoco’s secure payment page and are never seen or stored by us.
- We may change prices at any time, but changes never affect an order you have already paid for.
4. How your order becomes a contract
Placing an order is an offer to buy. The agreement between you and Saya Africa is concluded once your payment has been successfully processed and we send you an order confirmation email. We will not charge your card before then.
If a product is out of stock, or a price or description on the website is obviously wrong, we may cancel the order. If we do, we will tell you and refund you in full as soon as possible, and in any event within 30 days.
5. Delivery
We deliver to street addresses in South Africa with The Courier Guy. Dispatch times, delivery times and costs are explained in our Shipping & Delivery policy.
6. Your right to cancel, returns and refunds
You may cancel an online purchase within 7 days of receiving your goods, without giving a reason, as provided by section 44 of the Electronic Communications and Transactions Act. Defective products are covered by the 6-month warranty in section 56 of the Consumer Protection Act. How this works, including what we can and can’t accept back for health and hygiene reasons, is set out in our Returns & Refunds policy.
7. Your personal information
We collect and use your personal information only to process your order, deliver it, provide customer service and, if you agree, send you news and offers. We handle it in line with the Protection of Personal Information Act (POPIA) and our Privacy Policy, which you can open from the link at the bottom of every page. Your payment is processed by Yoco, and your delivery details are shared with The Courier Guy so that they can deliver your parcel.
8. Using this website
- All content on this website, including text, images, logos and product designs, belongs to Saya Africa (PTY) Ltd or is used with permission. You may not copy or reuse it for commercial purposes without our written consent.
- You must not misuse the website, for example by attempting to access it without authorisation or by placing fraudulent orders.
- We try to keep the website available and accurate, but we can’t guarantee that it will always be uninterrupted or free of errors.
9. Liability
To the extent permitted by law, Saya Africa is not liable for any indirect or consequential loss arising from your use of this website or our products. Nothing in these terms limits any right you have under the Consumer Protection Act or any other law that cannot be excluded.
10. Complaints
If you are unhappy with anything, please contact us first at info@saya.africa and we will do our best to resolve it quickly. If we can’t resolve it, you may refer the matter to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission (www.thencc.gov.za).
11. General
- These terms are governed by the laws of the Republic of South Africa.
- We may update these terms from time to time. The version on this page when you place your order is the one that applies to that order.
- If any part of these terms is found to be unenforceable, the rest remains in force.

Saya Africa (PTY) Ltd (“Saya Africa”, “we”, “us”) respects your privacy. This policy explains what personal information we collect when you use saya.africa, buy from us, or apply to become a Saya consultant, why we collect it, who we share it with, and the rights you have under the Protection of Personal Information Act (POPIA).

2. What we collect
When you place an order: your name, email address, cellphone number, billing and delivery address, the products you buy, and your order history. If you create an account, we also store your login details (your password is encrypted and we can’t see it).
When you pay: card payments are handled entirely by Yoco on its secure payment page. We never see or store your full card details; we only receive confirmation that the payment succeeded, with a transaction reference.
When you apply to become a consultant: your name, email address, cellphone number, province, town, street address, postal code, any notes you add, and the date and time you gave your consent to be contacted.
When you contact us by email, phone or WhatsApp: your contact details and what you tell us.
When you browse the website: technical information such as your IP address, browser and device type, and pages viewed, collected through cookies and similar technologies (see section 8).
3. Why we use it
- To fulfil your order: processing payment, packing and delivering your parcel, sending order and delivery updates, issuing invoices and receipts, and handling returns and refunds. This is necessary to carry out our agreement with you.
- To handle your consultant application: passing your details to the Saya distributor closest to you so that they can contact you, as you consented to when you applied.
- To provide customer service and respond to your questions and complaints.
- To keep records we are required to keep, such as invoices for tax purposes.
- To protect our business and customers, for example by preventing fraud and keeping the website secure. This is our legitimate interest.
- To send you news and offers, only if you have agreed to receive them or, if you are an existing customer, about products similar to those you bought. Every marketing message includes an easy way to unsubscribe.
We only collect what we need for these purposes, and we don’t sell your personal information.
4. Who we share it with
We share personal information only with service providers who need it to help us serve you, and who must keep it confidential and secure:
- Yoco: card payment processing
- The Courier Guy: delivering your order (your name, delivery address and cellphone number)
- Zoho Books: invoicing and accounting
- Domains.co.za: hosting our website and email in South Africa
- Saya distributors and consultants: only the details from a consultant application, so that the nearest distributor can contact you
- Our professional advisers (such as accountants and auditors), and authorities where the law requires it
5. Information stored outside South Africa
Some of our service providers, such as Zoho, may store information on servers outside South Africa. When this happens, we make sure the provider is subject to data-protection laws or binding agreements that give your information a level of protection similar to POPIA, as required by section 72 of POPIA.
6. How long we keep it
- Orders, invoices and payment records: for at least 5 years, as required by tax law, and for up to 7 years for company accounting records.
- Consultant applications: 12 months after your application if you don’t go on to join us, after which we delete them.
- Customer accounts: until you ask us to close your account, subject to the record-keeping periods above.
- Marketing preferences: until you unsubscribe or withdraw your consent.
7. How we protect it
We use appropriate technical and organisational measures to keep your personal information safe, including an encrypted (HTTPS) connection across the whole website, password-protected systems with access limited to staff who need it, and a payment provider (Yoco) that meets card-industry security standards. If we ever discover that your personal information has been accessed without authorisation, we will notify you and the Information Regulator as POPIA requires.
8. Cookies and third-party content
Cookies are small files stored on your device. We use:
- Essential cookies, which keep your cart, checkout and login working. The website can’t function without them.
- Optional cookies for analytics or marketing, which we only set if you accept them in the cookie banner. You can change your choice at any time.
Some parts of the website load content from other companies, such as our Facebook, Instagram and YouTube feeds, Google reviews, fonts, and the WhatsApp chat button. These companies may collect information such as your IP address under their own privacy policies. If you message us on WhatsApp, WhatsApp’s terms and privacy policy also apply.
9. Your rights
Under POPIA you have the right to:
- ask whether we hold personal information about you, and request a copy of it;
- ask us to correct or update information that is inaccurate or incomplete;
- ask us to delete information we no longer need or have no lawful reason to keep;
- object to us using your information for direct marketing or on the basis of our legitimate interests;
- withdraw your consent at any time, where we rely on consent (this doesn’t affect anything we did before you withdrew it); and
- lodge a complaint with the Information Regulator (www.inforegulator.org.za).
To exercise any of these rights, email our Information Officer at rahul@saya.africa with enough detail for us to identify you. We may need to confirm your identity before acting on a request, and we’ll respond within a reasonable time. Our PAIA manual, which explains how to request records, is available on request.
10. Children
Our website and products are intended for adults. We don’t knowingly collect personal information from anyone under 18. If you believe a child has given us their information, please contact us and we will delete it.
11. Changes to this policy
We may update this policy from time to time. The latest version is always on this page, with the date it was last updated. If we make significant changes, we will let you know by email or on the website.
